CASE SUMMARY 1
In the case between S v C, a man represented by Charity Manyeza was given a wholly suspended jail term after he struck his neighbour with an iron bar consequently causing his death. The man pleaded not guilty to the charge of murder and was convicted of a lesser charge of culpable homicide after causing the death of his neighbour who was in an affair with the accused person’s under-aged niece. The court considered that the accused person had acted in self defence as the deceased had ganged up other villagers with the aim of attacking the accused person. C was of ill health and therefore not fit to serve a jail term. As a result of the lawyer’s hard work, the accused person was sentenced to five years in jail which was wholly suspended for five years on condition that the accused does not within that period commit an offence where violence is an element.
In the case of S v A where A was facing rape allegations, the complainant had filed rape charges at the police station and a docket was opened.
A trial date was set based on those allegations. A alluded to the fact that he had been in a sexual relationship with the complainant for a period of one year. The matter was withdrawn before plea by the District Public Prosecutor as the complainant dropped charges against A and the accused person (A) was given a not guilty verdict and acquitted. It is important for a prosecutor to carry out thorough investigations before concluding that the matter is ready for trial. This is so as people (especially from rural areas as observed in my years of practice) demand payment of bride price when they make discoveries that someone has been engaging into sexual relations with their daughter. Failure to pay the bride price often results in allegations of rape. Therefore due diligence should be done when carrying out investigations especially in matters like rape and indecent assault.
CASE SUMMARY 2
Mhaka Attorneys has competent lawyers who handle pro deo cases at the instruction of the State. As a means of paying back to the society, legal fees are not charged and lawyers represent the clients at the best of their abilities. This was observed in a pro-deo case between S v D, where D was accused of murder after she caused the death of her husband by stabbing him after an altercation. The husband had died as a result of the stab wound. D was 20 years of age at the time and had a child with the deceased.
The accused pleaded guilty and entered a limited plea of culpable homicide citing that the accused had no intention of killing the deceased and that he had died as a result of negligence on the part of the accused. In mitigation it was raised that the accused person had been married to the deceased at an early age of 16 and that at the time of death the deceased was 22 years old. The husband was not formally employed and was a gold paner and that the two young persons had not received proper guidance on how to solve disputes amicably without using force.
The marriage between the accused and the deceased was characterised by violence. The society, including the mother of the accused, had failed the accused person as after entering the child marriage, they had neglected the accused person and despite reports of the abusive nature of the deceased, the accused was sent back to the husband. The father of the accused person had left the accused person at the age of two and the mother who was a hairdresser did not give her attention as she had so much on her plate. This had resulted in the relationship of the accused with the deceased which resulted in the birth of their minor child. The court gave the accused person a wholly suspended sentence.
